3dpixel Ltd. trading as 3DPixelNet (The Provider) agrees to furnish services to the Client, subject to the following Terms Of Service.

Use of 3dpixelnet's service constitutes acceptance and agreement to 3DPixelNet's Acceptable Use Policy as well as 3DPixelNet's Terms Of Service.

The Terms Of Service and Acceptable Use Policy may be changed from time to time at the discretion of 3DPixelNet in order to:

  • Clarify a particular point or aspect of the Terms Of Service or Acceptable Use Policy
  • Anticipate a new threat or requirement

Disclosure Of Information To Authorities

The Acceptable Use Policy specifically prohibits the use of 3DPixelNet's service for illegal activities. Therefore, the Client agrees that the Provider may disclose any and all Client information including assigned IP numbers, account history, account use, etc... to any authorised authorities or agents who make a written request without further consent or notification to the Client. In addition 3DPixelNet shall have the right to terminate all services set forth in this Agreement.

Refunds

All payments for hosting accounts to 3DPixelNet are nonrefundable outside of the 28day period after which the Client has deemed to accept the service provided. All payment disputes or cases of overcharging must be reported to 3DPixelNet within 28 days.

The Client acknowledges that the services provided is of such nature that services can be interrupted for many reasons other than the negligence of 3DPixelNet and that damages resulting from any interruption of service are difficult to ascertain. Thus, the Client agrees that 3DPixelNet shall not be liable for any damages arising from such causes beyond the direct and exclusive control of 3DPixelNet. The Client further acknowledges that 3DPixelNet's liability for its own negligence may not, in any event exceed an amount equivalent to charges payable by the Client for services during the period damages occurred. In no event shall 3DPixelNet be liable for any special or consequential damages, loss or injury.

Transfer of Domains

New webhosting accounts which involve the transfer of a domain from another provider to 3DPixelNet; whether they are FULL transfers or nameserver transfers, will require a period of time to propagate on to 3DPixelNet's DNS servers. In some cases, such transfers may take up to sixty (60) days. Due to the unpredictable nature of the transfer process, no guarantees are made regarding the amount of time a specific transfer may take. It is the responsibility of the Subscriber to cover any administration and/or costs of the domain transfer to our DNS servers. The costs of service commence from the point of purchase and not from the point of apparent DNS completion. If the customer cancels service during the transfer period for any reason, all charges are considered earned. The 28 day refund period however, does commence from the moment the 3DPixelNet DNS servers resolve the domain in question.

Support Boundaries

3DPixelNet provides technical support to the Client via email services. 3DPixelNet staff limit technical support to their area of expertise. Email support is limited in the main to the hours of 8am to 8pm UK time. The servers are monitored and acted upon if necessary 24 hours a day 365 days a year.

The following is our guidelines when providing support:

  • 3DPixelNet provides support related to your server's, or virtual site's actual physical functioning.
  • 3DPixelNet does not offer technical support for application specific issues such as CGI/Perl programming, HTML or any such coding issue outside of specifics relating to the server.
  • 3DPixelNet does not provide technical support for your customers.

SPAM and Unsolicited Commercial Email

3DPixelNet takes a zero tolerance approach to the sending of Unsolicited Commercial Email or SPAM from the 3DPixelNet servers. Very simply, this means that the Client of 3DPixelNet may not use, or permit others to use 3DPixelNet's network to transact in SPAM or Unsolicited Commercial Email. The Client may not host, or permit hosting of, sites or information that is advertised by Unsolicited Commercial Email from other networks. Violations of this policy carry severe penalties, including termination of service.

Upon investigation of alleged SPAM or Unsolicited Commercial Email activities, either via a third party, or via 3DPixelNet's monitoring systems, 3DPixelNet may restrict the Client access to 3DPixelNet's network or servers for the duration of the investigation.

Phishing and Brand Spoofing

The Client acknowledges that accounts hosted by 3DPixelNet shall not be used for "phishing" or other "scam" activities. Investigation protocols are as for SPAM violations.

Reselling

Resale of 3DPixelNet's services are permitted taking into account support boundaries described above. 3DPixelNet allows use of these Terms & Conditions and indeed recommends the Client uses the same, or stricter wording when reselling 3DPixelNet services.

Bandwidth and Disk Usage

The Client agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the services ordered by the Client. 3DPixelNet will monitor the Client's bandwidth and disk usage. 3DPixelNet has the right to take corrective action if the Client's bandwidth or disk usage exceeds the agreed usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all services, or termination of this Agreement, which actions may be taken is in 3DPixelNet's sole discretion. If 3DPixelNet takes any corrective action under this section, the Client shall not be entitled to a refund of any fees paid in advance prior to such action.

3DPixelNet will charge £1 plus vat per total Gigabyte of traffic/bandwidth over and above the total monthly limit of the Client's account. This amount is due at the end of the calendar month.

System and Network Security

The Client is forbidden to violate or attempt to violate the security of the 3DPixelNet servers. Violations of system or network security may result in civil or criminal liability. 3DPixelNet will investigate occurrences, which may involve such violations and may involve, and cooperate with, relevant authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:

  • Accessing data not intended for the Client or logging into a server or account, which the Client is not authorized to access.
  • Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
  • Attempting to interfere with service to any Client, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".
  • Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
  • Use of scripts to connect a server to remote servers. This includes remote shell, IRC, FTP servers.

Other

3DPixelNet is not responsible for the content of any other websites linked to the 3DPixelNet servers; links are provided as Internet navigation tools only.

3DPixelNet is not responsible for any damages your business may suffer. 3DPixelNet does not make implied or written warranties for any of our services. 3DPixelNet denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by 3DPixelNet.

It is absolutely forbidden to host pornographic content or IRC servers on 3DPixelNet's servers. 3DPixelNet accounts found hosting this material will be subject to immediate cancellation without refund.

You, as 3DPixelNet's Client, are solely responsible for the content stored on and served by the Client's 3DPixelNet account.
